Misdemeanor Crimes & Charges in Arlington, Virginia

In Arlington, VA misdemeanor crimes are those not considered as serious as felony criminal offenses, as in all other states. While you may be charged with a misdemeanor offense, it does not mean the repercussions are not serious. Arlington criminal defense attorney Elizabeth Tuomey of the Tuomey Law Firm understands that most people, particularly those facing criminal charges for the first time, do not understand the differences between a misdemeanor and felony, and the consequences if found guilty.

A misdemeanor crime will not leave you facing a slap on the hand along with a warning; in fact, many charges leave those convicted facing jail time, substantial fines, and a criminal record which can negatively impact employments opportunities, housing, and other privileges those with clean records in Virginia enjoy.

Consequences of a Misdemeanor Conviction in Virginia

If you are convicted of a misdemeanor crime, the conviction will remain on your criminal record forever, just as with a felony conviction. When seeking employment, potential employers are allowed to ask on job applications or during an interview whether you have ever been found guilty of a crime, regardless of whether it was a misdemeanor or felony. Additionally, those found guilty of a misdemeanor offense may face up to 12 months in jail, fines of up to $2,500 depending on whether the offense was classified as a class one, two, three, or four misdemeanor, driver's license suspension, and other sanctions.

Misdemeanor charges are grouped into separate categories according to Virginia criminal codes including traffic/DUI or DWI, fraud or larceny, drugs/alcohol offenses, assault/threat, and other. In regards to misdemeanor classes, they are outlined by state law as follows:

  • Class 1 misdemeanors are the most serious and include assault and battery, petit larceny, trespassing, solicitation, prostitution, sexual battery, reckless driving, and driving under the influence. Punishment may include a maximum of one year in jail along with fines up to $2,500 and other penalties.
  • Class 2 misdemeanors are less serious and may result in up to six months in jail along with fines of up to $1,000 for those convicted. Driving without a Valid License is a Class 2 misdemeanor.
  • Class 3 misdemeanors leave those found guilty facing fines of up to $500. Curse and Abuse is a Class 3 misdemeanor.
