Like most other states, a BAC (blood alcohol content) of 0.08 or above may result in DUI charges. Even if it is a first offense, your driver's license will be suspended immediately for seven days. However, a higher BAC level results in harsher punishment. For example, a BAC of between 0.15 and 0.20 will likely result in a jail term of five days if convicted; higher than that, and jail time increases to 10 days. In most cases first-time offenders may be granted a restricted license by the court.


At a very minimum individuals who are found guilty of DWI or DUI will pay court costs, a $250 fine, and face a one-year license suspension. In cases where the defendant's BAC level is .14 percent or less, jail time is not likely for first offenders. However, if you do not successfully complete ASAP (Alcohol Safety Action Program) and fail to pay all court costs and fines, you may be ordered by the court to serve a suspended jail sentence.


The punishment an individual faces depends on the blood alcohol content level, whether it is a first, second, third, or subsequent DUI offense and other factors. If an accident is involved, the prosecutor will likely ask for jail time to be served. In addition, a second or third DWI offense will leave you facing driver's license revocation for three years, higher fines, a lengthy jail sentence, including mandatory minimum jail time, and potentially permanent forfeiture of your vehicle. Those arrested for DUI for a third time within a 10-year time period face felony charges and permanent forfeiture of your driver’s license.
